Pickleball is a physical sport played at speed in a shared court. Its ordinary risks include, without limitation: collisions with other players, falls, sprains and strains, being struck by a ball or paddle, and reactions to physical exertion. These risks exist even when the court, equipment, and players are in good order and everyone is playing properly.
By booking a court, joining the open play queue, or otherwise playing at Pickle Island, you voluntarily and knowingly assume these risks, for yourself and for anyone you bring — including a minor in your care, on whose behalf you confirm you have the authority of a parent or legal guardian to accept this Waiver.
In consideration of being allowed to use our courts and facilities, and to the fullest extent permitted by the laws of the Republic of the Philippines, you release Pickle Island, its owner, and its staff from liability for injury, loss, or damage arising from the ordinary risks of pickleball described above, including injury caused by ordinary negligence in the operation of the facility.
Philippine law does not permit a waiver to excuse fraud, gross negligence, or willful misconduct — under Article 1171 of the Civil Code, any waiver of liability for future fraud is void, and courts treat a waiver of gross negligence the same way as a matter of public policy. Nothing in this Waiver releases Pickle Island from liability for those, or from any statutory obligation — including consumer-protection duties under the Consumer Act (Republic Act No. 7394) — that the law doesn’t allow a business to waive.
By playing, you confirm you know of no medical condition that would make it unsafe for you to play pickleball, or that you’ve consulted a physician and been cleared to do so. Stop playing and tell a staff member immediately if you feel unwell or are injured during a session.
Use courts and any rented or house equipment (paddles, balls, and similar items) only as intended, and report any damaged equipment or court surface to staff rather than continuing to use it. You’re responsible for the cost of any equipment you damage through misuse.
A parent or legal guardian must accept this Waiver on behalf of any player under 18, confirming both the assumption of risk above and that the minor is fit to play, before that minor is added to a booking or the open play queue.
By playing at Pickle Island, you grant us permission to use photos or videos taken during play — of you or any guest or minor in your care — for promotional purposes on our social media and website. If you’d rather not be included, tell a staff member and we’ll leave you out of anything we publish going forward.
Signing this Waiver also confirms your consent, under the Data Privacy Act of 2012 (Republic Act No. 10173), to Pickle Island collecting, storing, and processing your personal information — including your name, contact details, signature, and booking or play history — for facility operations, safety records, and customer service. We don’t sell your data or share it with third parties for marketing without your separate consent. The signature you draw at signup confirms you’ve read and understood this Waiver in full, along with our Terms of Service and Privacy Policy, and that you sign it voluntarily.
